ARTICLE-1 - These conditions govern sales on the CCTCAFÉ INC. website ( www.chateauantigua.com ).
ARTICLE-2 - When you place an order with CCTCAFÉ Inc. ( www.chateauantigua.com ), this means that you fully accept these general terms and conditions of sale of CCTCAFÉ Inc. and the conditions of your coffee order. Consequently, you must accept all the conditions provided below before ordering products from CCTCAFÉ Inc.
ARTICLE-3 - If there are any differences between the products delivered and those listed on the site ( www.chateauantigua.com ) and they do not relate to the essential characteristics of the product, freshness and quality, no cancellation of the order or refusal of delivery will be accepted.
ARTICLE-3.1 - The exact representation of the products on our website cannot be guaranteed due to differences that may exist: The colors used by the internet browsing software and/or screens, cell phones, etc. As a result, CCTCAFÉ Inc. cannot be held responsible and no legal action may be taken following the composition of the photos representing our products.
ARTICLE-4 - Goods ordered from CCTCAFÉ Inc. ( www.chateauantigua.com ) are intended for consumers only. Unless authorized by CCTCAFÉ Inc., goods ordered on the site of ( www.chateauantigua.com ) are prohibited from resale and are exclusively reserved for your consumption and/or personal use.
ARTICLE-5 - Our promotional offers consist of products presented online within the limit of available inventories.
ARTICLE-5.1 - If the ordered products prove to be unavailable (out of stock, supply delay, etc.) we will inform the customer by email and invite them to cancel or modify their order and/or delivery date. If the products prove to be permanently unavailable after placing the order, we will automatically cancel it and inform the customer by email before proceeding with a full refund of the missing products.
ARTICLE-5.2 - All our products present on the website are exclusively deliverable in Canada and more particularly in Quebec.
ARTICLE-6 - All sales prices indicated for each product include the taxes in force with the exception of delivery costs. Transport costs will be calculated at the time of placing the order. The total amount due by the customer will be indicated when confirming the order.
ARTICLE-6.1 – CCTCAFÉ Inc. reserves the right to modify its prices without notice, while guaranteeing the customer the application of the price in effect on the day of the order. Additional transport, delivery or postage costs (to which must be added any other costs incurred by CCTCAFÉ Inc.), will appear on the purchase order and must be read and accepted by the customer before finalizing the order.
ARTICLE-6.2 – CCTCAFÉ Inc. will confirm to the customer the receipt of his order. This confirmation will be communicated by email summarizing the products ordered, the delivery address, the means of payment while indicating an order number. The information provided by the customer when placing the order binds him: In the event of an error by the customer in the wording of these contact details or his place of delivery, in particular his name, first name, address, telephone number, email address, door code, floor, resulting in the loss of the products. The customer remains responsible for the payment of the lost products and no compensation or refund will be issued.
ARTICLE-6.3 – For all orders validated by CCTCAFÉ Inc., the usual shipping times are plus or minus 5 working days from the date of acceptance of payment by our merchant accounts. This is an average time depending on the destination, shipping method and availability of the item. Exceeding this time limit cannot give rise to any cancellation of the order, any reduction in the price paid by the buyer and any payment in damages, provided that the products are delivered within 30 working days following the registration of the order. Beyond this 30-day period, the customer may request a refund for unshipped items.
ARTICLE-6.4 – Under no circumstances can CCTCAFÉ Inc. be held responsible for the consequences due to a delay in delivery by the agencies used by CCTCAFÉ Inc. or any other carrier.
ARTICLE-6.5 – In the event of damage or non-conformity of the order, the customer must notify CCTCAFÉ Inc. of any anomaly by email with request for acknowledgment of receipt within three days after delivery. It will be up to the customer to provide all supporting documents necessary for the proper consideration of the claim. Any claim made outside this period cannot be accepted by CCTCAFÉ Inc. and be held responsible for the non-performance of the delivery.
ARTICLE-6.6 - Any modification of the order by the customer after confirmation thereof is subject to acceptance by CCTCAFÉ Inc.
ARTICLE-7 - CCTCAFÉ Inc. accepts payments by:
credit card, PayPal, or any other payment system authorized by CCTCAFÉ Inc. The customer's account will be debited when the order is placed. In the event of unavailable Products, the amount of the order will be fully refunded. In the event of inability to pay, delay or other default, CCTCAFÉ Inc. may suspend the order without prejudice or possible claim for the customer.
ARTICLE-8 - In the event of force majeure or unforeseeable circumstances, neither party may be held liable for the total or partial non-performance of its obligations. A case of force majeure may include, in particular: lightning, flood, earthquake, storm, fire, carrier strike, shortage of raw materials, etc. This list is not exhaustive. The party faced with a case of force majeure or unforeseeable circumstances must inform the other party as soon as possible and no later than seven (7) working days of the occurrence of the event in question.
ARTICLE-8.1 - The parties will then determine together, within thirty (30) days, the terms of execution of the order during the duration of the force majeure event which one of the parties is facing.
ARTICLE -8.2 - If the force majeure event lasts for more than thirty (30) days and CCTCAFÉ Inc. is still unable to honor the order, the order may be terminated at the request of the injured party. It will be the responsibility of CCTCAFÉ Inc. to fully reimburse the customer for the amounts paid by him in respect of said order.
ARTICLE-9 – The elements and/or information reproduced on the site ( www.chateauantigua.com ) are the exclusive property of CCTCAFÉ Inc. They are protected by copyright, trademark law and patent law.
Any reproduction or distribution of these elements, without prior written authorization from CCTCAFÉ Inc., exposes offenders to legal action.
ARTICLE-10 – CCTCAFÉ Inc. collects your personal data (first and last name, address, email address) only for the purposes of fulfilling orders.
ARTICLE-11 – CCTCAFÉ Inc. uses “cookies”. These cookies allow us to recognize you on a subsequent visit. In addition, if you use an “online shopping cart”, cookies allow us to remember the products you have selected. If you do not wish to receive cookies, consult the “Help” file of your browser which will guide you to block all cookies or receive a warning before a cookie is stored on your computer. Please be aware, however, that by blocking cookies, you may not be able to take full advantage of all the functions offered by CCTCAFÉ Inc.
ARTICLE-11.1 - We only store and use personal data that you provide to us directly or that are clearly provided to us for processing purposes as mentioned above or as mentioned when you provide us with personal data. We will not use personal data for other purposes without your prior consent. We protect your personal data by a number of security measures such as the use of secure registration forms, data encryption and restricted access to your personal data.
ARTICLE-11.2 - The place of execution is that of the head office of CCTCAFÉ Inc. located at: Casier Postal 92, St-Eustache, Québec, J7R4K5.
Any dispute relating to the validity and interpretation of these general conditions of sale, as well as any dispute relating to the conclusion, interpretation, acceptance, execution and/or cancellation of any order, will be submitted exclusively to the Courts of the jurisdiction of CCTCAFÉ Inc. (Quebec).
ARTICLE-11.3 - In the event that one or more of the provisions of the contract or of these general conditions of sale should be declared null and void, the validity of the other conditions will not be affected.
